1. Introduction
These Terms & Conditions (“Terms”) govern your use of the services, website, and communications provided by Sigura Construction, Inc. (“Company,” “we,” “our,” or “us”), including inquiries, consultations, estimates, scheduling, and communications conducted through our website, email, telephone, text message, social media platforms, online directories, advertising platforms, referrals, or any other communication channel operated or used by the Company.
By accessing our website, contacting us, requesting information, scheduling a consultation, submitting an inquiry, or otherwise engaging with the Company through any communication channel, you acknowledge that you have read, understood, and agree to these Terms, to the extent permitted by applicable law.
2. Scope of Services
These Terms apply to all preliminary communications, consultations, estimates, proposals, scheduling, and other interactions with the Company prior to the execution of a written construction agreement.
If a written construction agreement is executed between the parties, that agreement shall govern the construction project and shall control in the event of any conflict between these Terms and the signed agreement.
3. Website Use & Informational Purpose
This website is provided for general informational purposes and to allow users to request information regarding construction, remodeling, and design services.
We reserve the right to modify, update, or discontinue any part of the website at any time without notice.
4. No Contractual Relationship
Use of this website, submission of a contact form, or communication with our team does not create a contractor-client relationship.
A formal relationship is only established upon execution of a written, signed construction agreement by both parties.
5. Lead Submissions & Communication Consent
By submitting your information, you agree that:
- The information provided is accurate
- You are requesting contact regarding our services
- We may contact you via phone, email, or text message regarding your inquiry
6. Right to Refuse Service
Sigura Construction, Inc. reserves the right, in its sole discretion and in compliance with applicable federal, state, and local laws, to decline or discontinue consultations, estimates, proposals, scheduling, or construction services for any project or prospective client.
The Company may decline projects that are outside its service area, expertise, scheduling capacity, licensing limitations, business objectives, or for any other lawful business reason.
7. Estimates & Consultations
We offer free initial consultations and estimates for qualifying projects.
You acknowledge and agree that:
- All estimates are non-binding and provided for informational purposes only.
- Estimates are based on preliminary information and may change following a site inspection, design development, engineering review, or clarification of the project scope.
- Final pricing is established only through a fully executed written construction agreement.
- We do not guarantee the accuracy of estimates due to unknown site conditions, material price fluctuations, permitting requirements, design changes, or other unforeseen circumstances.
- We do not guarantee that estimates or proposals will be prepared or delivered within any specific timeframe. The time required to prepare an estimate varies based on project complexity, scheduling, workload, and the availability of the information needed to prepare an accurate proposal.
8. Complimentary 3D Design Services
The Company may offer complimentary conceptual 3D design services for qualifying projects at its sole discretion.
You acknowledge and agree that:
- Complimentary 3D design services are not guaranteed.
- Eligibility is determined solely by the Company based on project size, feasibility, scheduling, and other business considerations.
- All renderings, drawings, concepts, models, plans, and related design materials remain the exclusive intellectual property of Sigura Construction, Inc. unless otherwise agreed in writing.
- Conceptual designs are preliminary and subject to revision throughout the design and construction process.
- Complimentary design services do not obligate the Company to enter into a construction agreement.
9. Change Orders
Construction projects frequently require modifications due to changing conditions, unforeseen circumstances, or client requests.
You acknowledge and agree that:
- Any changes to project scope, materials, specifications, design, engineering, or unforeseen site conditions may require a written change order.
- Approved change orders may affect pricing, project duration, scheduling, and scope of work.
- Additional work will not be performed without written authorization from both parties.
- Verbal requests, text messages, or verbal approvals are not binding unless confirmed in writing by the Company.
10. Payment Terms
Payment obligations are governed by the signed construction agreement.
Unless otherwise specified:
- Deposits may be required before work begins.
- Progress payments may be required according to project milestones.
- Final payment is due upon substantial completion or as otherwise provided in the signed agreement.
- Late or unpaid balances may result in suspension of work until payment issues are resolved.
- The Company reserves all rights and remedies available under the construction agreement and applicable California law.
Failure to make payments when due may result in additional charges, project delays, suspension of services, termination of work, mechanic’s lien rights where applicable, or other remedies permitted by law and contract.
11. Project Delays & External Factors
Construction schedules are estimates unless expressly guaranteed in writing.
The Company shall not be responsible for delays resulting from circumstances beyond its reasonable control, including but not limited to:
- Permit or inspection delays
- Weather conditions
- Material shortages
- Manufacturer or supplier delays
- Labor availability
- Utility interruptions
- Municipal requirements
- Acts of God
- Natural disasters
- Public emergencies
- Unexpected site conditions
- Client-requested changes
- Delays caused by third-party consultants, engineers, architects, utility providers, or governmental agencies
12. Intellectual Property
All website content, including images, text, logos, designs, and 3D models (including Matterport tours), are owned by Sigura Construction, Inc. unless otherwise stated.
You may not reproduce or use any content without written permission.
13. Third-Party Services
Unless otherwise stated, all website content and Company-created materials, including but not limited to:
- Logos
- Text
- Graphics
- Photographs
- Videos
- Renderings
- 3D models
- Matterport® tours
- Floor plans
- Design concepts
- Marketing materials
- Website layout and branding
are the exclusive property of Sigura Construction, Inc. and are protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified, published, or used without prior written permission from the Company.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Sigura Construction, Inc. shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:
- Loss of profits
- Loss of business opportunities
- Business interruption
- Delays
- Cost overruns
- Unknown site conditions
- Material shortages
- Reliance upon website content, marketing materials, or preliminary estimates
Construction services are governed exclusively by the applicable signed construction agreement.
15. No Warranty or Guarantee of Results
While we strive to provide exceptional workmanship and customer service, we do not guarantee:
- Exact project completion dates
- Exact final project costs prior to contract execution
- Continuous availability of labor or construction materials
- Uninterrupted construction due to external circumstances
- Approval of permits, zoning requests, variances, HOA approvals, or governmental applications
- Financing approval or insurance claim approval
Any timelines, schedules, estimates, or completion dates provided prior to contract execution are estimates only unless expressly guaranteed in writing.
16. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.se Terms are governed by the laws of the State of California, United States.

We reserve the right to modify these Terms at any time.
Updated versions will be posted on this page and become effective upon publication unless otherwise stated.
